REMERGE Transaction Coordinators has been ready for the 2005 California transaction since last November. The Seller's disclosures and Master checklist are updated. We have incorporated Buyer's Election to Order or Waive on all inspections as well as make a last ditch effort to persuade the Buyer to buy a Home Warranty if one has not been included in the purchase agreement.

ARE YOU READY?

Real estate agents must be aware of the following mandatory changes to their contracts and reports.

1. LISTING AGREEMENT: As of 10/04, there are 3 different Residential Listing Agreements: "Exclusive","Agency" and "Open". Make sure you use the right one.

NHD: The Zone Disclosure and the summary page, NHD must be endorsed by the company that provides the report. REMERGE will check for validated reports.

PROPERTY TAX: D.R.E. no longer accepts preliminary title report tax summary or property tax statement or sparse tax information that is included in some zone disclosure reports. When you are on the Seller's side, REMERGE orders CA Tax Data report that complies with D.R.E. requirements. When you are on the Buyer's side, request CA Tax Data by name, to be paid by the Seller on the purchase agreement, page 2 Item B4 and that REMERGE will order it. If the Seller's Agent is unaware or refuses to order the property tax report, REMERGE will order it. The report will be charged to the Buyer or you.

Another week to go and we'll be rockin' and rollin' into the 2005 market. All prognosticators agree that California real estate will continue to appreciate about 15% this year. This is less than last year's average 23% but it is still a league better than anyone can expect in typical bank or Wall Street investment!

Ask them if they want to make a good return on their equity by investing in more real estate. It not too late to cash in on the California gold rush!
